How do I relocate out of state if my ex and I share joint custody of our daughter?
Ok so here is the situation, My ex boyfriend and I have a four year old daughter who the court granted joint legal and physical custody of. I have been granted more about 66% physical and he has been granted 33%. I have recently remarried and have a baby on the way. Both my husband and I work in the casino industry and we have been thinking of relocating from San Diego to Las Vegas, about a four hour drive. The original court order states that neither of us can move the child out of the county without the other parents consent. but the cost of living in san diego is too high and Im sure that my husband and I can provide a better standard of living if we skip over to the next state. My question is;
-If it’s possible how do I go about geting the court approval for a relocation?
and
-What tips does anyone have for making this change a smooth as possible?

You cannot move without the child’s father’s permission.

You can’t. You have a court order. You can try getting a lawyer..or move up to temecula where there are also several casinos and also in palm springs. Double check if its just County or State.. Most of the time you can not move the kids out of STATE only…

You need a good attorney for this or an understanding ex. It sounds as if without his permission, you’d need some good legal arguments, and that with his permission it would be trivial. I know couples who’ve done this without court. You may have to give him some sort of financial incentive or extra-visitation incentive or convenience incentive (like driving the kids back and forth), but if you can negotiate something friendly out of court it’s a lot better than spending a lot on legal fees and maybe losing anyway.
